These Terms of Use outline the rules for the use of any websites and any online services (collectively the “Website”) provided by Physiotherapy Education Accreditation Canada (“PEAC”, “we”, “us”, “our”), a federally incorporated not-for-profit organization.

If you are a minor, do not use the Website. By using the Website, you accept and agree to be bound by these Terms of Use on your own behalf and on behalf of the organization you represent. If you go not agree, do not use the Website. We may make changes to these Terms of Use from time to time without notice. The Last Updated date above indicates the effective date of the latest version of these Terms of Use. By using the Website, you agree to the latest version of these Terms of Use.

  1. No Ownership Transfer
    1. Title and intellectual property rights of the Website remain exclusively with PEAC. Intellectual property rights include the look and feel of the Website. These Terms of Use constitute permission to use only. Nothing in these Terms of Use transfers any ownership rights to you in any way.
    2. Any violation of these Terms of Use may be fully enforced by PEAC or the relevant copyright owner allowed by law.

    1. We grant you a non-transferable, non-exclusive, revocable, limited right to access and use the Website according to the terms and conditions under these Terms of Use.

You agree to indemnify and hold PEAC, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against PEAC by any third party due to or arising out of or in connection with your use of the Website.
  6. Limitation of Liability
    1. WE WILL NOT BE LIABLE FOR ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO, LOSS OF PRODUCTION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, OR ANY OTHER BUSINESS OR ECONOMIC DISADVANTAGE SUFFERED BY YOU ARISING OUT OF THE USE OR FAILURE TO USE THE WEBSITE, WHETHER OF NOT THE DAMAGES WERE FORESEEABLE AND WHETHER OR NOT PEAC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, OUR AGGREGATE LIABILITY SHALL BE NIL ($0). THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
  7. Governing Law and Forum
    1. These Terms of Use will be enforced or construed according to the laws of the Province of Ontario, Canada, without regard to conflict of law principles. You may not bring any claim more than two (2) years after the underlying cause of action first accrued.
    2. Any dispute, action, or proceeding arising out of these Terms of Use shall be submitted to the exclusive jurisdiction of the courts in the city of London in the Province of Ontario.
  8. Communication with Us
    1. You may communicate with us by sending us an email at info@peac-aepc.ca.
    2. If you suggest improvements or enhancements to the Website or communicate to us ideas for new applications or services (“Suggestions”), PEAC may use such Suggestions (except for any information you claim is confidential) without restriction of any kind. You hereby irrevocably assign to PEAC all rights, titles, and interests in and to the Suggestions (other than your confidential information) and agree to provide PEAC with any assistance we require to document, perfect, and maintain PEAC’s rights in the Suggestions.
  9. Interpretation
    1. These Terms of Use constitute the entire agreement between you and PEAC with respect to your use of the Website. If any provision of these Terms of Use is held to be invalid, unenforceable or illegal, such provision will be stricken and the remaining provisions enforced. Notwithstanding any other provisions of these Terms of Use, any provision of these Terms of Use that governs continuing rights or obligations on you or us will survive the termination of these Terms of Use, including, without limitation, the indemnification and limitation of liability provisions.
